1) Scope

1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders for goods placed via the online shop of Epic-Couture OG (hereinafter “Epic-Couture” or “we”). Any differing terms from the customer shall not apply unless explicitly agreed upon.

1.2 These GTC also apply accordingly to the purchase of vouchers, unless otherwise stated.

1.3 A "consumer" is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. A "business customer" is any natural or legal person or partnership acting in the course of their business or self-employed professional activity.


2) Contract Formation

2.1 The products displayed in our online shop do not constitute binding offers. They are an invitation for the customer to submit a purchase offer.

2.2 Customers submit a binding offer by completing the order process in the online store and clicking the final order button. Offers may also be submitted by phone or email.

2.3 We may accept this offer within five days, either by confirming the order in writing or via email, by dispatching the ordered goods, or by requesting payment. The contract is concluded as soon as one of these actions occurs first.

2.4 The contract text will be stored and sent to the customer via email. Customers with an account can view their order history by logging in.

2.5 Before submitting the order, all data can be reviewed and corrected using standard browser or keyboard functions.

2.6 The language of contract and communication is German.

2.7 Order confirmations and correspondence are sent by email. The customer must ensure that the provided email address is valid and can receive messages.


3) Right of Withdrawal

3.1 Consumers are entitled to a statutory right of withdrawal.

3.2 Details can be found in our separate cancellation policy.


4) Prices and Payment

4.1 All prices include VAT. Shipping costs are listed separately.

4.2 Payment options are shown during checkout.

4.3 If prepayment is agreed, the invoice is due immediately unless otherwise specified.

4.4 If the customer selects the "SOFORT" payment option, payment is processed by SOFORT GmbH. More information is available at https://www.klarna.com/sofort.


5) Shipping and Delivery

5.1 Orders are shipped to the address provided unless agreed otherwise.

5.2 If delivery fails due to customer fault, the customer bears the return costs unless otherwise legally entitled.

5.3 Self-collection is not possible.

5.4 Vouchers are provided via email or digital download.


6) Retention of Title

Goods remain our property until full payment is received.


7) Warranty

7.1 Legal warranty rights apply to all goods.

7.2 We recommend reporting visible transport damage to the courier and notifying us. This does not affect statutory warranty rights.


8) Custom-Made Orders

8.1 For custom items, the customer must provide all content (e.g., images, texts) in appropriate formats and ensure usage rights are granted to Epic-Couture.

8.2 Customers indemnify Epic-Couture against any third-party claims arising from intellectual property or other rights violations related to provided content.

8.3 We reserve the right to reject any designs that violate legal or moral standards.


9) Gift Vouchers

9.1 Gift vouchers purchased via our shop are redeemable only in our online store.

9.2 Vouchers are valid for three years from the date of purchase. Unused credit will remain until expiration.

9.3 Vouchers must be redeemed before completing the order. Subsequent redemption is not possible.

9.4 Only one voucher can be redeemed per order.

9.5 Vouchers may not be used to purchase additional vouchers.

9.6 If the order exceeds the voucher value, a standard payment method must be used for the balance.

9.7 Vouchers cannot be exchanged for cash or interest.

9.8 Vouchers may be transferred to others. We honor valid vouchers unless we know of misuse or legal incapacity of the redeemer.


10) Applicable Law

Austrian law applies. If you are a consumer, this does not affect the protection provided by mandatory consumer rights in your country of residence.


11) Jurisdiction

If the customer is a business or public law entity based in Austria, the exclusive place of jurisdiction is our business location. For international business customers, the same applies if the transaction relates to their professional activity.


12) Online Dispute Resolution

12.1 The European Commission offers a platform for online dispute resolution:

12.2 We are neither obliged nor willing to participate in any alternative dispute resolution procedure before a consumer arbitration board.
